MINDSETS TERMS & CONDITIONS June 2013

  1. PRICING
    1. Mindsets retain the right to change prices without prior notification. Prices charged will be those prevailing at time of order.
    2. All prices are subject to VAT at the prevailing rate
    3. If there is a pricing error, we are under no obligation to supply the goods at the incorrect price. However, we will advise you of the correct price and you will be able to cancel your order if you wish.
    4. Quantity rates only apply to the specific quantity detailed or more. Further discounts for higher quantities may be available. Please contact us with details of your requirements
  2. ORDERING
    1. An official order number is required for all orders made on account. Alternatively payment may be made by credit/debit card.
    2. Schools may place an order by telephone or post providing an official school order number and school address details are supplied. When ordering, please supply the product code(s) for the specific products.
    3. If ordering by fax, please do not post a confirmation order (to avoid duplication). Again, an official school order is required.
    4. For Commercial customers a 30 day credit account may be opened subject to a completed application form and satisfactory Bank and Trade References. Credit levels will be set at this point by Mindsets
    5. You will be invoiced for your order when the goods are ready to be despatched unless payment is made by PayPal or credit card when your account will be debited immediately.
  3. POSTAGE/DELIVERY
    1. For the UK mainland, there is a standard charge of £4.95 (+ VAT) per order. For off-shore or Ireland, carriage is at cost – please telephone for details.
    2. If orders are received before noon, we aim to despatch goods within 48 hours if the goods are in stock. However, many items are made to order so please allow up to 28 days for your order to arrive. Please let us know if you need your order by a specific date and we let you know if we can meet your deadline. If we are unable to fulfil all the items on your order, the outstanding items will be forwarded separately as soon as possible.
    3. Collection of the goods may be made by prior appointment only. Please telephone before making your journey. Goods can only be released against an official written order from schools, or by payment by credit card.
  4. PAYMENT TERMS FOR TRADE ACCOUNTS
    1. All invoices are strictly payable within 30 days. Mindsets retain the right to charge interest at 5% over the Bank base rate for any overdue accounts.
    2. The goods remain the property of Mindsets until paid for in full. The customer must store the goods in a safe and secure environment until paid for.
    3. If goods have been sold on, either in their original state or incorporated into other products, the title of the goods remains with us until paid for in full and you shall be accountable for the outstanding proceeds.
    4. No goods will be despatched to overdue accounts.
  5. ORDER CANCELLATION, RETURNS AND EXCHANGES
    1. If you are not satisfied with your goods for any reason, please return any products to us within 14 days of receiving the order and we will give you a full refund. Products must be returned in their original packaging. Please note special orders and bespoke products cannot be returned without prior agreement.
    2. Before returning any products please contact us with your order number and the details of the products you wish to return. We will then issue you with a returns number which you should mark clearly on the outside of your parcel.
    3. Shortage claims must be made in writing within five days of receipt. Please retain all order/delivery paperwork.
    4. When returning goods, the parcel is the customer’s responsibility until it reaches us. We strongly recommend that you send it by registered post.
    5. We process returns as soon as possible except during extremely busy periods when there may be a short delay. Please note that credit card refunds can only be given to the original payer.
    6. We will cover the cost of returning any faulty products but if the products being returned are not faulty you must cover the cost of returning the goods to us. Please take reasonable care to ensure that any products being returned are not damaged during transit. Should you fail to do this, you will be charged with the cost of the return.
  6. GUARANTEE
    1. Our products are guaranteed to be free from defect caused by faulty materials or workmanship for a period of 12 months from the date of despatch.
    2. Goods that do not meet the description, are not of satisfactory quality or are not fit for the purpose specified will be refunded or replaced as appropriate.
    3. Mindsets liability under this guarantee will be limited to replacing, repairing, refunding or issuing credits for any goods returned to the limit of their original value.
    4. Every care has been taken to describe and portray items accurately, but slight variations in actual goods may occur.
    5. We are not liable under this guarantee for fair ‘wear and tear’ or if the goods have been used in a manner that could not reasonably have been expected in regard to their normal use.
    6. Any goods returned to us under this guarantee need to be suitably packed and accompanied by details of the defect and proof of purchase.
  7. MISCELLANEOUS
    1. Mindsets reserve the right to discontinue or alter any product without prior notice.
    2. All images are used for illustration purposes only.
    3. Mindsets will not be liable for any delay or failure to perform our obligations due to circumstances beyond our control including national emergencies, fire or flood, acts of God or omissions of third parties.

    5. Reproduction of any images or text outside of the educational environment is forbidden unless prior approval has been given.
    6. These conditions will be governed by and construed with the laws of England and Wales.
